The Yankee Candle Co. v. New England Candle Co.
14 F. Supp. 2d 154 (D. Mass. 1998)

In its opinion, the court indicated that while individual shops do not qualify as a building under 17 U.S.C. §101, the mall itself would. The history of shopping centers can be traced back to the market squares of ancient Europe. One of the first enclosed shopping structures in the world is the Grand Bazaar in Istanbul. In the United States, the first modern shopping center was built in 1922. The Country Club Plaza in Kansas City was built as a single structure housing multiple shops and based around a parking lot. The first fully enclosed mall, Southdale Mall, was built in 1956.

As a side note, The Yankee Candle Company still operates its store in Holyoke Mall.
